At Gryphon Host, we value our clients and wish to provide them with the best possible hosting experience. To offer you the best service possible, all clients need to follow the same rules and guidelines. These policies are intended to make Gryphon Host's service available to all our clients as consistently and efficiently as possible.
Specific Acceptable Use Policies
Gryphon Host ensures that all personal information being voluntarily submitted to us in the processing of your order (to be used for record and billing purposes, etc.), inclusive, but not limited to, credit card and other personal information, will be kept strictly confidential and used "solely" by Gryphon Host, its authorized representatives, and employees; for the strict purpose for which it was intended, and for the benefit of the subscriber. We agree not to share, rent, sell, or release this information to any individual, entity, or third party, for any reason, without the specific written consent of the subscriber; with exception as required by law, regulation, or governmental authority. Gryphon Host is committed to protecting and securing all subscriber-provided information, through the use of firewalls and additional security measures in place at its physical facilities to protect against the loss, misuse, or alteration of such information. Payment Policies All accounts are set up on a pre-pay basis. There is no commitment, obligation, or contract associated with any of our packages or plans. Clients may choose the period to pre-pay and may cancel their account at any time. Upon cancellation of services, client is responsible for all money owed on the account from the time it was established to the time that the client notifies Gryphon Host in writing for a request for termination of services. All pre-paid fees are non-refundable. Domain Registration fees are non-refundable. All payment is in U.S. currency. Service Cancellation To make a cancellation request, you will need to fill out the cancellation request form. If this is not possible, you may mail a cancellation request to Gryphon Host LLC, P.O. Box 8354, Turnersville NJ 08012. You must include your Account Domain Name and Account Password for the account which you wish to cancel hosting for. Should this information not be provided or not be correct, we will be unable to cancel the account for security reasons. Refusal of Service Gryphon Host reserves the right at its sole discretion to refuse or cancel service. Violation of any of Gryphon Host's Rules and Regulations could result in a warning, suspension, or possible account termination. Accounts terminated due to policy violations will not be refunded. Lawful Purpose Gryphon Host LLC reserves the right to refuse service to anyone. Clients may only use Gryphon Host LLC's servers for lawful purpose. Transmission of any material in violation of any Federal, State, or Local regulation is prohibited. This includes, but is not limited to copyrighted material, material legally judged to be threatening or obscene, and material protected by trade secrets. Gryphon Host expressly forbids anyone from using Gryphon Host servers for the propagation, distribution, housing, processing, storing, or otherwise handling in any way lewd, obscene, or pornographic material, or any other material which we deem to be objectionable, including, but not limited to, pornography, satanic materials, and any and all materials of an adult nature. The designation of any materials as such described above is left entirely to the discretion of Gryphon Host management. In addition any site selling or promoting bulk e-mail services is not allowed. Gryphon Host Account Management Applications We provide account management applications for the explicit use of our clients and their accounts with Gryphon Host. Any usage of the applications outside of the management of your account or intended use of the applications is strictly prohibited. The applications are provided to you "As Is", and we make no warranties, expressed or implied, as to their performance. We will not be held responsible for errors, interruptions in service, or loss of data as a result of these applications. These applications remain the intellectual property of Gryphon Host LLC, including documentation and help files. It is protected by copyright law, other intellectual property laws, and by international treaties. We do not allow the modification or creation of derivative works from all or any portion of the Gryphon Host Software, including (i) translation or localization; (ii) reverse engineering, recompilation, disassembling, or any other attempt to derive the source code for any Gryphon Host application provided to you. Link To Gryphon Host By copying the Gryphon Host logo, you may be granted a non-assignable, non-transferable, and non-exclusive license to use the logo on your internet website for the limited purpose of creating a hyperlink to www.gryphonhost.com. You may not use the logo for any other purpose without expressly written persmission. Copyright Notice All images, text, and related intellectual property is (c) Gryphon Host, LLC 2004 unless otherwise noted. Indemnification Client agrees that it shall defend, indemnify, save, and hold Gryphon Host LLC harmless from any and all demands, liabilities, losses, costs, and claims, including reasonable attorney's fees asserted against Gryphon Host LLC, its agents, its clients, officers, and employees, that may arise or result from any service provided, performed or agreed to be performed, or any product sold by client, it's agents, employees, or assigns. Client agrees to defend, indemnify and hold harmless Gryphon Host LLC against liabilities arising out of; (i) any injury to person or property caused by any products sold or distributed in association with Gryphon Host LLC's services; (ii) any material supplied by client infringing or allegedly infringing on the proprietary rights of a third party; (iii) copyright infringement and (iv) any defective products sold to client from Gryphon Host LLC's services. Disclaimer Gryphon Host LLC will not be responsible for any damages your business may suffer. Gryphon Host LLC makes no warranties of any kind, expressed or implied for services we provide. Gryphon Host LLC disclaims any warranty, merchantability, or fitness for a particular purpose. This includes loss of data resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions caused by Gryphon Host LLC and its employees. Gryphon Host LLC reserves the right to revise its policies at any time. Failure to follow any terms and conditions may result in account deactivation. Governing Law and Jurisdiction The validity and effect of this Agreement shall be governed by and construed and enforced in accordance with the laws of the State of New Jersey, without regard to its conflicts of law principles. Any suit, action, or proceeding concerning this agreement must be brought in a New Jersey State or Federal court located in Camden County, New Jersey, and each of the parties hereby irrevocably consent to the exclusive jurisdiction of such courts (and of the appropriate appelate courts therefrom) in any such suit, action, or proceeding and irrevocably waives, to the fullest extent permitted by applicable law, any objection which it may now or hereafter have to the laying of the venue of any such suit, action, or proceeding in any such court that any such suit, action, or proceeding which is brought in any such court has been brought in an inconvenient forum. |
